PRIVACY POLICY DEEPSKYCAMERA-APP

 

In the wake of the application of this app, your personal data will be stored by us as the parties responsible for data processing, and will be kept as long as it is required for the fulfillment of the determined purposes and legal responsibilities.

Below, we will inform you as to which data are concerned, how they are processed, and which rights you have in this matter.

According to art. 4, no.1 of the Datenschutzgrundverordnung DSGVO, (General Data Protection Regulation, GDPR), personal data are all information referring to an identified or identifiable individual.

2. Access Authorizations of DeepSkyCamera-App

 

DeepSkyCamera-App needs the following authorizations:

1. INTERNET (load data from the internet/access to all networks):

This is needed to load the list with supported smartphones from the internet, as well as to be able to send to the operator of the app by means of the function „Register Your Smartphone“ camera sensor data and questions or feedback.

 2. WRITE EXTERNAL STORAGE (fotos/media/data files/USB-storage):

 This is needed to store pictures on the smartphone.

 3. READ EXTERNAL STORAGE (fotos/media/data files/USB-storage)

This is needed to be able to show pictures taken with the internal filebrowser of the app DeepSkyCamera on the smartphone.

4. CAMERA:

This is needed to be able to take pictures with the integrated camera sensors.

 

3. Evaluation of camera sensor data

 

Camera sensor data will only be evaluated and stored, if you explicitly send the camera  sensor data via „Register Your Smartphone“ to the operator of the app. The camera sensor data will also be send to the operator, if via the function „Register Your Smartphone“ questions or problems are related.

 

The camera sensor data serve to continuously expand the list of supported smartphones (function „Supported Smartphones“). If mistakes, errors or bugs are reported, or suggestions for improvement are filed, the camera sensor data help us to continuously improve the app.

At the start of the app, the camera sensor data will be written to the file „deepskycamera-hardware-level.txt“, and will be only send with the function „Register Your Smartphone“ to the operator. You have access to the file at anytime; it does not contain personal data whatsoever. After the start of the app, it can be found in the following directory:

 

Android/data/de.seebi.deepskycamera/files/pictures.

You can send the camera sensor data anonymously to the operator via the function „Register Your Smartphone“, by not leaving any name, mail-adress or a message.

 

4. Sending of names and e-mail-addresses

Your name and e-mail-address will exclusively be send to the operator via the function „Register Your Smartphone“, if you deposit your name and your e-mail-address in the corresponding places and click on „Send“. Apart from this function, no personal data will be send to the operator.

 

5. Evaluation of use data

To ensure the secure operation of the camera, and for the further development of the DeepSkyCamera app, anonymous use data are evaluated. However, these data cannot be connected with your identity. We have no chance to associate these data with your person, and moreover, we also do not link these data with other data origins.

In the wake of the use of the DeepSkyCamera app, data will be stored in our log-file for reasons of security and statistical evaluation.

In this field we only record – for the duration of one month – the following data:

Name of the data file requested

·        Date and time

·        Data volume transmitted

·        Report whether the request was successful

·        Incase the request was successful: anonymized IP-address of the accessing host system

·        If the request was not successful: the complete IP-Address will be stored, for the purpose of mistake analysis and security.

 

6. Transfer of data to third parties

Data, which have been logged with the use of DeepSkyCamera app, will in principle only be transferred to third parties, in as far as this is statutory, determined by a court decision, or the transfer in the case of attacks on the internet infrastructure of seebi.systems, if this is necessary for criminal proceedings or an exercise of a right. A transfer for other than non-commercial or commercial purposes will not take place.

8.  Your rights

 

As a data subject, you have the right to:

 

·        withdraw the consent you have once given to us at any time, according to art. 7, para. 3 of the DSGVO (GDPR). As a consequence this means that we are not allowed to maintain the data processing, which was once based on your consent.

·        have access to your personal data being processed by us, according to art. 15 DSGVO (GDPR). You can especially ask for information about the data processing purposes, the category of the personal data, the category of recipients, to which your personal data have been or are being revealed, the planned duration of the storage, the existing right of rectification, deletion or restriction of the data processing, or objection, an existing right to file a complaint, the origin of your personal data, in case that these were not collected or requested by us;

·        to obtain from the controller without undue delay the rectification of inaccurate personal data, and to have incomplete personal data completed according to art. 16 DSGVO (GDPR).

·        to obtain from the constroller the erasure of your personal data stored by us, without undue delay, as long as the processing is not required for the exercise of the right to freedom of expression and information, for the fullfilment of a legal obligation, for reasons of public interest, or for the enforcement, the exercise or the defense of legal claims, according to art. 17 DSGVO (GDPR);

·        to demand the restriction of the processing of your personal data, in case that the correctness of the data is questioned by you, the processing is illegal, but you refuse these to be deleted and we do not need these data anymore, but you need these data for the enforcement, the exercise or the defense of legal claims, or you have filed a complaint against the data processing according to art. 21 DSGVO (GDPR);

·        to demand to receive your personal data, which you have provided to us, in a structured, common and machine-readable format, or to demand the transfer of the data to other parties in charge, according to art. 20 DSGVO (GDPR), and

·        to file a complaint with a supervisory authority, according to art. 77 DSGVO (GDPR). As a rule, for this purpose you can turn to the supervisory authority responsible for your usual place of residence or for your place of work or for our place of business.

 

Information about your right to complain according to art. 21 DSGVO (GDPR)

 

You have the right to file a complaint at anytime against the processing of your personal data concerning your identity due to reasons resulting from your particular situation, according to art. 6, paragraph 1 S 1 DSGVO (GDPR) (data processing in the public interest), and art. 6, paragraph 1 S 1 DSGVO (GDPR), (data processing on the basis of an assessment of interests). If you file a complaint, we will stop processing your personal data, unless we can provide evidence for compelling legitimate grounds for the processing, which would override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims.

If your complaint is directed against data processing for the purpose of direct mail, we will immediately stop the processing. In this case, a specification of a particular situation is not required.
